Criminal Defense Cases
April 2008: In the month after founding Nistler Law Office, Brent was brought on as co-counsel to another firm trying a first degree murder trial. The team persuaded the jury to reject the first degree murder allegation, and instead the jury found their client guilty of negligently handling a weapon. Instead of serving a sentence of life without parole, our client was only sentenced to four years in prison out of a maximum possible five years.
December 2008: Nistler Law Office successfully moved to suppress evidence in a gun case, resulting in a complete dismissal of the charges against our client.
July 2009: Nistler Law Office, as new counsel on a two year old drug conspiracy case carrying a penalty of 25 years in prison, convinced the District Attorney's Office to dismiss the charges on the eve of trial and refile substantially reduced charges.
March 2011: Representing a victim of theft, Nistler Law Office worked with law enforcement to secure a criminal conviction and successfully obtained a court order for restitution that included legal fees paid by our client.
May 2011: Nistler Law Office represented a client accused of 33 Felony Counts of Identity Theft. We successfully negotiated a plea to one count with no jail time, and the Court followed the joint recommendation.
Civil Litigation
September 2008: In a published decision, The 7th Circuit Court of Appeals agreed with Nistler Law Office that our client's civil rights case thrown out by the District Court should be reinstated and reversed the District Court's decision. Jackson v. Kotter, 541 F.3d 688, 698 (7th Cir. 2008)
July 2009: Nistler Law Office tried a five day, expert intensive breach of easement case against the Milwaukee Metropolitan Sewerage District. The Court awarded $1.08 million to our client; the exact amount we argued our client was entitled to. See news article in the Milwaukee Journal Sentinel.
August 2009: Nistler Law Office successfully moved to dismiss a defamation suit against our client filed in federal court resulting in zero liability for our client. The plaintiff's subsequent appeal to the 7th Circuit was also denied.
January 2010: Nistler Law Office defended a commercial eviction case on behalf of our Downtown Milwaukee business tenant. At the conclusion of trial, the Court sided with our client and the eviction action was dismissed.
June 2010: Nistler Law Office tried a two day jury trial which resulted in a finding that our client's neighbor was negligent in maintaining a nuisance that caused our client significant harm.
September 2010: Nistler Law Office successfully obtained a dismissal for a New York Federal Credit Union sued in Dane County on Personal Jurisdiction grounds.
February 2011: In a published decision, the Court of Appeals upheld our client's judgment against the Milwaukee Metropolitan Sewerage District (see July, 2009 above). Cianciola, LLP v. Milwaukee Metropolitan Sewerage Dist.
331 Wis.2d 740, 796 N.W.2d 806, 2011 WI App 35. In June 2011, the Wisconsin Supreme Court denied MMSD's petition for review.
June 2011: Nistler Law Office tried a 3 day jury trial defending two clients on a 1 million dollar contract claim. We successfully persuaded the Court to dismiss one client at the close of the plaintiff's case, and successfully persuaded the jury to find the other client had zero liability.
